THE COURT WILL HEAR ARGUMENTS ON THE GOVERNMENT’S MOTION TO DISMISS.
On Wednesday, May 16th, Judge Charles F. Lettow of the Court of Federal Claims will hold a hearing at 10am, in the United States Courthouse, 515 Rusk St., Houston. The Judge will hear arguments from counsel on the Government’s motion to dismiss our lawsuit, and our response. One of our Co-Lead Counsel, Mr. Ian Gershengorn of Jenner & Block, will argue for the plaintiffs’ side. We all worked closely with Ian on the briefing, and continue to help him prepare for this argument.
The hearing will be in Courtroom 11-B, and is open to the public. In this type of hearing, only the lawyers will speak to the Judge, and they will mostly discuss the legal issues raised in briefing (and not from any witnesses). Please note that seating for the public is limited.
WE WILL HOLD A PUBLIC TOWN HALL MEETING FOR THIS WEDNESDAY, AFTER THE HEARING.
These meetings are for upstream flood victims to learn about our lawsuit and to understand the status of the litigation and our plan for the case. For this meeting in particular, we will also provide updates about the court hearing this week. As always, we will share maps of the flooded areas, discuss the history of the Addicks & Barker Dams & Reservoirs, and we will stay until all questions are answered.
