On November 20, 2017, Chief Judge Susan G. Braden of the U.S. Court of Federal Claims appointed attorneys from Irvine & Conner and Burns Charest LLP to serve as co-lead counsel for the upstream cases.
Charles Irvine of Irvine & Conner PLLC and Daniel Charest and Larry Vincent of Burns Charest LLP have been appointed to litigate the question of liability for the upstream cases — that is, whether the federal government is liable for flooding homes, businesses, and personal property within the Addicks and Barker Reservoirs. Larry Vincent, Irvine & Conner’s co-counsel at Burns Charest, also has been appointed to take the lead on resolving jurisdictional issues, which will be resolved on a parallel track.
